These Terms & Conditions ("Terms") govern access to and use of FlexTrack, a gym and fitness facility management platform provided through the FlexTrack web dashboard and the FlexTrack mobile application, operated by Future Dev Solutions ("FlexTrack," "we," "us," or "our"). By registering for or using FlexTrack, you agree to these Terms.

1. Accounts and Roles

FlexTrack accounts are assigned one of the following roles, each with different permissions:

• Super Admin: platform-level administrator accounts operated by Future Dev Solutions.
• Owner: registers and manages a gym business, its locations, equipment inventory, staff, members, and subscription plans.
• Staff: granted access by an Owner to manage check-ins, members, and daily operations at assigned gym location(s).
• Member: an individual enrolled at a gym who uses FlexTrack to check in, view invoices/subscriptions, and use exercise-plan features.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration information, including your name, contact details, date of birth, and — where requested by your gym — a national identification number (CNIC), and keep it up to date.

2. Gym Owner Responsibilities

Owners are responsible for the accuracy of the gym, location, equipment, subscription, and billing information they enter, and for obtaining any consents required from their members and staff before entering the members'/staff's personal information into FlexTrack. Owners and Staff must only access member data for legitimate gym-management purposes.

3. Subscriptions and Billing

• Gym subscription plans define a price, duration, and the number of locations covered, and are assigned to an Owner's account with a start and end date.
• Members may separately be assigned membership/subscription plans by their gym.
• Invoices generated within FlexTrack record the amount, tax, discount, total, due date, status, and payment method. Payment methods (e.g. cash) are recorded by gym staff for bookkeeping; FlexTrack does not itself process card or online payments on your behalf at this time.
• You are responsible for settling amounts due to your gym according to the payment method and process your gym uses outside of FlexTrack, unless and until an integrated online payment method is introduced.
• We may send subscription-expiry and payment-due reminders via the app, push notification, or (where enabled by your gym) SMS.

4. Check-Ins and Attendance

FlexTrack lets members check in at a gym location via manual entry, QR code, NFC tap, or another automatic method configured by the gym. You agree to use only check-in credentials/codes issued to you and not to check in on behalf of another person, or use a QR/NFC code belonging to a gym location you are not a member of. "Location" in FlexTrack refers to the gym branch record you are associated with (e.g. which of your gym's addresses you attend) — FlexTrack does not track your device's real-time GPS location.

5. AI-Generated Exercise Plans

FlexTrack may generate personalized monthly exercise plans using a third-party AI language model, based on the fitness level, goals, and workout frequency you provide, and the equipment registered at your gym. AI-generated plans are provided for general fitness informational purposes only, are not medical or professional fitness advice, and are not guaranteed to be accurate, safe, or suitable for your individual health condition. Consult a qualified healthcare or fitness professional before starting any exercise program, and stop immediately if you experience pain, dizziness, or discomfort. You use AI-generated plans at your own risk.

6. Mobile Application Terms

The FlexTrack mobile app allows you to check in, view your membership/invoices, follow exercise plans, and receive push notifications (such as missed-workout reminders, subscription reminders, and gym announcements) via a device notification token associated with your account. You may lose access to push notifications by uninstalling the app, revoking notification permissions, or unsubscribing from a topic. Standard data charges from your mobile carrier may apply.

7. Communications

By using FlexTrack, you consent to receive account, billing, attendance, and gym-announcement communications from us and from your gym through the app, push notification, email, and — where a gym enables it — SMS. Administrative and transactional messages (such as OTPs, password resets, and invoice notices) cannot be opted out of while you maintain an account.

8. Acceptable Use

You agree not to:

• Access or attempt to access data, gyms, or locations you are not authorized to view.
• Circumvent role-based access controls or impersonate another user, gym, or role.
• Misuse check-in methods (e.g. sharing or forging QR/NFC codes) to falsify attendance.
• Upload false CNIC, identity, billing, or health/fitness information.
• Interfere with, reverse-engineer, or overburden FlexTrack's systems, including our scheduled background jobs and APIs.
• Use FlexTrack for any unlawful purpose or in violation of applicable gym, health, or data-protection regulations.

9. Intellectual Property

FlexTrack, its software, branding, and design are owned by Future Dev Solutions and protected by applicable intellectual property laws. You retain ownership of the content and data you input (such as gym, member, and invoice information), and you grant us a license to host, process, and display that content solely to provide the FlexTrack service to you.

10. Suspension and Termination

We may suspend (block) or deactivate an account that violates these Terms, engages in fraudulent check-ins or billing, or poses a security risk. Owners may deactivate Staff or Member accounts they manage. You may request deletion of your account subject to our data-retention obligations described in the Privacy Policy.

11. Disclaimer of Warranties

FlexTrack is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service, including AI-generated exercise plans, will be uninterrupted, error-free, or medically appropriate for you.

12. Limitation of Liability

To the maximum extent permitted by law, Future Dev Solutions and FlexTrack will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of FlexTrack, including reliance on AI-generated exercise plans or billing information entered by a gym.

13. Indemnification

You agree to indemnify and hold harmless Future Dev Solutions from claims, damages, and expenses arising from your misuse of FlexTrack, violation of these Terms, or violation of any rights of a third party (including a member whose data you entered without proper consent).

14. Governing Law and Dispute Resolution

Placeholder — to be confirmed by counsel: these Terms are intended to be governed by the laws of Pakistan, where Future Dev Solutions and FlexTrack are based, and disputes are intended to be resolved in the courts of that jurisdiction, unless otherwise required by applicable law. This section should be reviewed and finalized before publication.

15. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above when we do, and continued use of FlexTrack after changes take effect constitutes acceptance of the revised Terms.
